Welcome to Mincemeat. These Terms and Conditions ("Terms") govern your access to and use of the Mincemeat website, platform features, managed cloud hosting, static site deployment, and infrastructure services (collectively, the "Services"). By registering for an account or using our Services, you agree to comply with and be bound by these Terms.

1. Services Provided

Mincemeat provides a suite of developer-focused tools, including managed Linux infrastructure, performance engineering solutions, and automated deployment pipelines. We reserve the right to modify, update, or discontinue any part of the Services at any time, provided that we will make reasonable efforts to notify you of significant changes.

2. Account Registration and Security

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and keep your account details updated. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breach.

3. User Responsibilities and Acceptable Use

You agree to use our Services only for lawful purposes. You must comply with our Acceptable Use Policy, which is incorporated by reference into these Terms. You specifically agree not to:

  • Use the Services to host, store, or distribute illegal, infringing, or highly objectionable content.
  • Disrupt or attempt to circumvent the security mechanisms of the Mincemeat platform or underlying infrastructure.
  • Exceed the resource limits allocated to your specific service tier without proper authorization or payment.

4. Payment and Billing

  • Fees: You agree to pay all applicable fees for the Services you select, as detailed on our pricing page or in a separate service agreement.
  • Billing Cycle: Services are billed on a recurring basis (e.g., monthly or annually) in advance.
  • Non-Payment: Failure to pay invoices when due may result in the suspension or termination of your Services.
  • Refunds: All fees paid are non-refundable unless explicitly stated otherwise in these Terms or required by law.

5. Intellectual Property

  • Your Content: You retain all rights, title, and interest in the code, data, and content you deploy or host using Mincemeat ("User Content"). You grant us a limited license to host, copy, and transmit your User Content solely as necessary to provide the Services.
  • Our Platform: Mincemeat retains all intellectual property rights in the Services, including the platform architecture, interfaces, and underlying software.

6. Limitation of Liability

To the maximum extent permitted by law, Mincemeat and its affiliates, directors, or employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, but is not limited to, loss of profits, data, use, or goodwill, arising from:

  • Your access to or use of (or inability to access or use) the Services.
  • Any conduct or content of any third party on the Services.
  • Any unauthorized access, use, or alteration of your transmissions or content.

In no event shall our aggregate liability exceed the total amount paid by you to Mincemeat during the twelve (12) months immediately preceding the claim.

7. Termination

You may terminate your account at any time by following the instructions in your dashboard. We may suspend or terminate your access to the Services at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, your right to use the Services will immediately cease, and your data may be deleted in accordance with our data retention policies.

8. Modifications to the Terms

We reserve the right to update or modify these Terms at any time. We will provide notice of material changes via email or through the platform dashboard. Your continued use of the Services after such updates constitutes acceptance of the revised Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the applicable laws of the jurisdiction in which Mincemeat is formally registered, without regard to its conflict of law provisions.
